This Privacy Policy explains how Firesong Marketing, LLC, a Utah limited liability company ("Firesong Marketing," "we," "us," or "our"), collects, uses, and shares information when you visit firesongmarketing.com (the "Site"), fill out a form, request an audit or resource, use our services, or contact us by phone, email, or text message.
1. Information we collect
Information you give us. When you fill out a form, text us, email us, or call us, we collect what you provide. That may include:
- your name and business name
- your email address
- your phone number, including a mobile number
- your website address
- any message or details you choose to share
- whether you opted in to text messages, how, and when (your "SMS opt-in data")
Information collected automatically. When you use the Site, we and our hosting provider may collect:
- the page you came from and the pages you visit
- your browser type and device information
- a one-way hashed version of your IP address, used to prevent spam and abuse
We use Tandem Analytics, a privacy-focused, cookieless analytics tool run on our hosting provider's own servers, to count visits and see which pages are used. It collects page addresses, referring sites, browser, device and operating system type, language, and approximate location (country, region, city). It does not use cookies or track you across other websites. To count unique visitors it briefly uses your IP address and browser information to create an anonymous identifier that changes regularly; your IP address is not stored in our analytics data.
Information from scheduling tools. When you book a call through our scheduling page, Google Calendar appointment scheduling handles the booking, and Google's privacy policy also applies to what you enter there.
When you pay us, card payments are processed by Stripe under Stripe's privacy policy. Firesong Marketing, LLC does not store full card numbers.
2. How we use information
We use information to:
- respond to you and provide the audit, resource, or service you asked for
- send materials you requested, such as an e-book by email
- communicate with you about your request and our services, including by text message only if you opted in (see Section 3)
- run, secure, and improve the Site and prevent spam and abuse
- keep business records and meet legal obligations
3. Text messaging (SMS)
If you opt in to texts from Firesong Marketing, we use your mobile number to send the messages described in our SMS Terms. Message frequency varies. Message and data rates may apply. Reply STOP to opt out or HELP for help at any time. Opting in is never required to request an audit, download a resource, or buy any service.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the categories of sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with or sold to any third parties. The messaging platform and wireless carriers that deliver our texts receive your number only to deliver them.
4. How we share information
We do not sell your personal information, and we don't share it with third parties for their own marketing.
Except as limited by Section 3, we share information only:
- With service providers that help us run the Site and our business, such as website hosting, email delivery, text message delivery, and scheduling. They may use it only to provide services to us.
- For legal reasons, when required by law, subpoena, or other legal process, or to protect the rights, property, or safety of Firesong Marketing, our clients, or others.
- In a business transfer, such as a merger, reorganization, or sale of assets, where this Privacy Policy continues to apply to your information.
- With your consent.
None of these exceptions allow sharing mobile numbers or SMS opt-in data and consent for marketing or promotional purposes.
5. Cookies
Our site does not use advertising or tracking cookies, and the public site does not set its own cookies. Tandem Analytics does not use cookies. Fonts are served from our own site. The scheduling page embeds Google Calendar, which loads from Google and may set its own cookies under Google's privacy policy.
6. How long we keep information
We keep inquiry and lead information as long as needed to respond to you and keep our business records, generally no longer than 12 months after our last contact, unless the law requires longer. If you opt out of texts, we keep a record of your opt-out so we can honor it.
7. Your choices
- Email: use the unsubscribe link in any marketing email, or email us.
- Text messages: reply STOP to any message.
- Access, correction, or deletion: email john@firesongmarketing.com, and we'll respond within a reasonable time. Depending on where you live, you may have more rights under state privacy laws.
8. Security
We use reasonable administrative, technical, and physical safeguards, including encrypted (HTTPS) connections to the Site. No method of transmission or storage is completely secure.
9. Children
The Site and our services are for business owners and adults. They aren't directed to children under 13, and we don't knowingly collect personal information from children under 13. Our text program is only for people 18 and older.
10. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. We'll post the updated version on this page and change the "Last updated" date.
